ALPINE APERTURE

PHOTOGRAPHY LICENSE & USAGE TERMS

**Effective Date:** August 11, 2026

These Photography License & Usage Terms (“Terms”) apply to all photography, video, drone footage, virtual tours, floor plans, and other media (“Media”) created and delivered by **Josh Cook, doing business as Alpine Aperture** (“Alpine Aperture,” “Photographer,” “we,” “us,” or “our”).

By booking, purchasing, receiving, downloading, or using Media from Alpine Aperture, the client (“Client,” “Agent,” “you,” or “your”) agrees to these Terms.

1. LIMITED LICENSE

Upon payment for the applicable services, Alpine Aperture grants the Client a **limited, non-exclusive, non-transferable license** to use the Media solely to market and promote the specific real estate property for which the Media was created.

Permitted uses include:

* MLS and other real estate listing services
* Agent and brokerage websites
* Social media
* Digital and online advertising
* Print advertising
* Flyers, brochures, and property marketing materials
* Property websites
* Email marketing
* Other ordinary marketing activities directly related to the sale of the property

This license is a **license to use the Media, not a transfer of ownership or copyright**.

2. LICENSE PERIOD

The license begins when the Media is delivered and remains valid **until the property is sold or the Client's listing of the property is terminated**, whichever occurs first.

After the property is sold or the listing is terminated, all rights granted under this license expire unless Alpine Aperture provides written permission for continued use.

Continued use after expiration may require an additional licensing fee.

3. THE LICENSE BELONGS TO THE CLIENT

The license is granted specifically to the **individual or business that books and pays for the photography services**.

The license does not automatically transfer to:

* The property owner or seller
* A buyer or future property owner
* Another real estate agent
* A different agent representing the same property
* A brokerage or real estate team
* A builder or developer
* A property manager
* A contractor or other service provider

If multiple agents, teams, or brokerages wish to use the Media independently, each party must obtain permission from Alpine Aperture.

4. NO TRANSFER, RESALE, OR SUBLICENSING

The Client may not sell, transfer, assign, sublicense, distribute, or otherwise grant independent usage rights to the Media to another person or entity.

In particular, the Client may not provide the original Media to another agent or brokerage for use in a subsequent or competing listing.

The Client may provide Media to vendors, MLS providers, advertising platforms, or other service providers when reasonably necessary to carry out the Client's authorized marketing of the property. Such use does not give those parties ownership or independent licensing rights.

5. FUTURE LISTINGS & RELISTINGS

The license applies only to the **specific listing and marketing period for which the Media was created**.

If the property is subsequently relisted, transferred to another agent, marketed by a different brokerage, or otherwise placed on the market again after the original license has expired, the existing Media may not be reused without written permission from Alpine Aperture.

Alpine Aperture may require a new license or additional licensing fee for any subsequent listing or marketing period.

6. SELLER & PROPERTY OWNER USE

Payment for photography services by an Agent does not grant the property owner or seller an independent license to use the Media.

If the seller or property owner wishes to use the Media independently—for example, for a future sale, rental, vacation property listing, personal website, or other purpose—separate written permission from Alpine Aperture is required.

7. COPYRIGHT & OWNERSHIP

Alpine Aperture retains all copyrights and intellectual property rights in the Media.

The Client does not acquire ownership of the photographs, videos, or other Media by purchasing photography services.

The Client may not claim the Media as its own work, register the Media under its own copyright, or sell the copyright or ownership rights to another party.

8. EDITING & ALTERATION

The Client may resize, crop, compress, or make minor technical adjustments to the Media as necessary for authorized marketing.

The Client may not materially alter, distort, manipulate, or otherwise modify the Media in a way that substantially changes the Photographer's work or misrepresents the property without prior written permission from Alpine Aperture.

9. PROHIBITED USES

Unless separately authorized in writing, the Client may not:

* Use the Media to market a different property.
* Use the Media after the license period has expired.
* Use the Media for a future or subsequent listing.
* Sell or sublicense the Media.
* Transfer the Media to another agent or brokerage for independent use.
* Use the Media for unrelated commercial purposes.
* Submit the Media to stock photography or licensing services.
* Claim ownership or copyright of the Media.
* Remove copyright or ownership information from the Media.

10. PHOTOGRAPHER'S PORTFOLIO RIGHTS

Alpine Aperture retains the right to display and use the Media for its portfolio, website, social media, advertising, promotional materials, publications, competitions, and other business-related promotional purposes.

11. MEDIA STORAGE

Once Media has been delivered, the Client is responsible for downloading and retaining copies needed for authorized use.

Alpine Aperture is not obligated to permanently archive Media and may remove or discontinue storage of Media after delivery.

12. ACCEPTANCE

By booking services, submitting payment, accepting delivery, downloading, or using Media from Alpine Aperture, the Client acknowledges that they have read, understood, and agreed to these Photography License & Usage Terms.

These Terms govern the Client's use of Media unless Alpine Aperture expressly agrees to different terms in writing.
